Privacy Policy

Be Someone Sports may collect and use information needed to operate its website, registrations, communications, programs, payments, scheduling, rosters, athlete recognition, and related services. Privacy practices — including information collected from parents/guardians and minor athletes — will be addressed in Be Someone Sports' Privacy Policy and the children's privacy / COPPA-related section below.

You acknowledge and agree that Be Someone Sports may, in its sole discretion, preserve or disclose your personal information — such as email addresses, IP addresses, time-stamps, and other user information — if required to do so by law or in the good-faith belief that such disclosure is reasonably necessary to: comply with legal process; enforce these Terms of Service; respond to claims that any content violates the rights of third parties; or protect the rights, property, or personal safety of Be Someone Sports, its users, or the general public.

Children's Online Privacy (COPPA)

Protecting the privacy of the very young is especially important. For that reason, we never collect or maintain information at our Site from those we actually know are under 13, and no part of our website is structured to attract anyone under 13. The Be Someone Sports website is intended for general audiences and is not directed to children under 13. By accessing the Be Someone Sports website, you represent that you are 13 years of age or older. If you are between 13–18 years of age you need permission from a parent or guardian to use our Sites and Services. If you permit your child or legal ward between 13–18 years of age (your "Child") to use the Sites and Services, you hereby agree to these Terms of Use on behalf of yourself and your Child. You further agree that you are solely responsible for all use of the Be Someone Sports website by your Child, regardless of whether you authorized such use. Be Someone Sports encourages parents to use appropriate parental discretion in determining whether to grant authorization to minor children to access our Sites and Services.

Be Someone Sports collects certain personal information about children, including their first and last names. This information is only used to place a child on a team and is only kept for as long as needed to provide the requested services. Children do not have access to make their personal information publicly available on the Be Someone Sports website. All personal information is collected from the child's parent or authorized legal guardian. By creating an account through Be Someone Sports and providing the requested personal information, the parent and/or authorized legal guardian provides verifiable parental consent to Be Someone Sports' use of the personal information. If a parent wants to review or request deletion of the child's personal information, please contact: Be Someone Sports at info@besomeonesports.com. No child's personal information is shared with any third party without parental written consent. The information collected is only maintained for a period of five (5) years, and then it is deleted from Be Someone Sports systems.

Attorney review: Confirm that the five-year retention period and contact channel reflect current Be Someone Sports operating practices across registrations, rosters, waivers, stats, Be Someone TV, Find My Player, exposure, accounting, and third-party systems. FTC guidance says COPPA may apply to sites/services directed to children under 13 or general-audience sites that have actual knowledge they collect personal information from a child under 13.

Shipping & Delivery

At this time, Be Someone Sports ships merchandise to locations within the United States and U.S. territories, including Alaska, Hawaii, Puerto Rico, Guam, and the US Virgin Islands. Additionally, Be Someone Sports ships merchandise to Canada and Mexico, but not to other international locations. The risk of loss and title for all merchandise ordered on this website pass to you when the merchandise is delivered to the shipping carrier.

International

Customs and import duties may be applied to international orders when the shipment reaches its destination. Such charges are the responsibility of the recipient of your order and vary from country to country. Contact your local customs office for details.

Shipping laws are different in each country. It is your responsibility to check with your customs office to verify whether the country to which you are shipping permits the shipment of your products. Be Someone Sports is not responsible for any direct, indirect, punitive, or consequential damages that arise from improper international shipping practices.

Sales Tax

Be Someone Sports charges sales tax for merchandise ordered on this website based on the applicable state sales tax rate and the location to which the order is being shipped.

You may purchase merchandise from this website using any of the payment options listed at checkout. Be Someone Sports reserves the right to change its payment procedures at any time without prior notice to you.

Payment Processing

Be Someone Sports may obtain payment from you via an integrated payment portal with third-party banking institutions and processing agents (the "Payment Processors"). Such Payment Processors receive the information needed to verify and authorize your credit card or other payment information. These Payment Processors adhere to the standards set by PCI-DSS and are managed by the PCI Security Standards Council. Be Someone Sports is not responsible for processing the payment. We do not store or collect your payment card details, do not handle any of your funds, and are not involved in any payment processing between you and Payment Processors. You agree that Be Someone Sports is not liable in any way to you arising from or related to (directly or indirectly) payment processing transactions between you and the Payment Processors.

Void Where Prohibited

Although the information on this website is accessible worldwide, not all products or services discussed in this website are available to all persons or in all geographic locations or jurisdictions. Be Someone Sports and the advertisers each reserve the right to limit the provision of their products or services to any person, geographic area, or jurisdiction they so desire, and to limit the quantities of any products or services that they provide. Both parties expressly waive the right to a trial by jury to the extent permitted by law.
